INTRODUCTION TO RESTRICTIVE COVENANTS - FOR HOME-OWNERS. Restrictions come by local zoning, deed, and restrictions. If recorded at the County – use title search. Landowners are bound by the stricter of recorded Restrictive Covenants and local zoning. A HOA or neighbor can enforce - courts will enforce recorded objective covenants. Infringing or pleading ignorance of restrictions can be costly. Defenses: Covenant is too vague; violates public policy; or impossible to carry-out. Seek legal counsel – helpful to seek agreement from neighbors.
